The Expert’s Liability for the Performance of Expert Activities

Abstract

The new 2004 Expert Witness Act has changed the perspective on both the performance and responsibility of expert witnesses. Over two decades, legal and judicial practice in this area has been established. This article evaluates current practice and summarizes how expert responsibility is understood, and how the risk of negative social impacts from expert activities is assessed and mitigated.
