Abstract

Business names are an integral part of business. They are one of the basic identification features of an entrepreneur and distinguish the entrepreneur in the economic competition. It is therefore extremely important to pay attention to compliance with legal requirements when creating trade names and using them in business transactions. The right creation of a trade name protects the rights of other competitors, consumers, and their owners themselves. In the article, the author analyzes the concept of a business name and the principles of its creation according to Slovak commercial law. It emphasizes the principles that natural persons and legal entities must observe when registering and using the names under which they conduct their business activities. The analysis of the related provisions of the Commercial Code is supplemented by the author’s illustrative examples of trade names for a better understanding of the issue, and the author’s interpretation of the law is based on (mainly) Slovak related jurisprudence.
