Equivalence of direct and representative constitutional power

Abstract

Constitutional Court of the SR emphasised the equivalence of the exercise of constitutional power directly by citizens in the referendum and representative by the members of the National Council of the SR. The contribution analyses this equivalence in terms of the form, content and extent of constitutional power, in terms of the extent of the possibilities for interference with the material core of the Constitution. In conclusion, it represents the author’s solution in relation to the protection of the material core of the Constitution in the exercise of constitutional power.
