Reasons for detention of a foreigner for the purpose of administrative expulsion pursuant to the Act on the Residence of Foreigners in the Czech Republic

Abstract

The detention of a foreigner and hence the restriction of freedom is a fundamental interference with the life of every person. The Act on the Residence of Foreigners in the Czech Republic defines the basic conditions in which such intervention may occur and only in these situations defined by the law can the Police take such a fundamental step in the process of expulsion of a foreigner. The paper focuses not only on detention of a foreigner in the Czech Republic, but also on other aspects of assessment and decision-making in the case of detention of a foreigner.
