Legal aspects of limiting access to information

Abstract

The present article categorizes different kinds of information and then focuses attention to which groups of information with limited access. In accordance with the Constitution of the SLOVAK republic it is necessary to mention that there are also other legal regulations with the force of law that are of importance from the point of view of the implementation of the fundamental right to information. These may in fulfilling its purpose, also determine the restriction of the right on access to information, but only in the cases provided for in čl. 26 sec. 4 of the constitution. In particular, from the constitutional point of view questionable, if a special law vylučoval from the disclosure of the entire documents. Most likely not such an exclusion comply with the constitutional requirement of proportionality, and minimization of intervention into the fundamental right to information, since it will not apply the rule,the selection of“ only the truly sensitive“ information, but it will be a flat rate of maintaining the confidentiality of all the information contained in the documentation, and it will be therefore in contradiction with the Constitution of the Slovak republic.
