Relationship between state and municipality on the example of guaranteed energy services

Abstract

The article deals with the relationship between the state and the municipality in the area of energy efficiency by analyzing the amendment to the Energy Efficiency Act in terms of contracting energy efficiency contracts for the public sector. The primary task of the article is to analyze the energy efficiency contract for the public sector, which is concluded by the municipality with the state and related legislation that complete the complex functioning of the state and municipalities in the area of energy efficiency. One of the described areas of the article is also possible contact with the Constitution of the Slovak Republic in the clash between state and municipality in question, if the state did not interfere authoritatively in the self-governing position of municipalities in determining the content of the energy efficiency contract directly from the law, specifically to independent economy of municipalities with own assets and own funds.
