Abstract

In criminal proceedings, it is necessary to respect and apply general constitutional principles relating to basic rights and freedoms guaranteed by the Constitution of the Slovak Republic. These must be taken into account primarily (but not only) in the law-making (de lege ferenda) activity of the legislator. Constitutional principles create postulates for standards contained in criminal procedure regulations. In norm-making activities, it is also necessary to pay attention to the international obligations of the Slovak Republic when changing criminal law regulations, which result not only from the wording of international treaties, but also from the decision-making activities of the highest judicial authorities. By taking into account the limits of criminal proceedings, which result from some constitutional norms and international legal obligations of the Slovak Republic, the fulfillment of the doctrine of the positive obligation of the state will be achieved at the same time.
