Routine Road Inspection and Preventive Safety Inspection

Abstract

Part of the activity of police officers is the performance of official activities and official interventions. Police officers must act within the limits of the relevant legal regulations when performing official activities and official interventions. In practice, however, police officers carry out official interventions that may not be in accordance with the law. The most common illegal intervention can be a „preventive safety inspection“. Also, the performance of the so-called „routine road inspection“ may appear to be illegal. Such acts of police officers are not explicitly defined in any legal regulation and are subsumed under official action or official activity. However, can police officers carry out such official interventions and activities when no crime or misdemeanour has been committed or when there is no reasonable suspicion of their commission?
