Lien on Real Estate as a Security Measure of the Court in Cadastral Practice

Abstract

In the article in question, the authors discuss the normative regulation of the lien on real estate as a security measure of the court, which was established by the court procedure according to article 343 of the Act No. 160/2015 Coll. Civil Dispute Procedure Code as amended in proceedings for the issuance of a security measure. The authors pay special attention to the form of registration of this lien on the real estate in the land registry and the impact of the court´s decision on the establishment of the lien on real estate as a security measure for which began before the delivery of this court decision to the district office. The authors also discuss the issues of extinction and deletion of the said lien on the real estate from the land registry.
